2. These terms and related policies

These terms govern use of our website and purchases made through our Shopify store. They should be read with our:

3. Website use

You may use the website only for lawful purposes. You must not interfere with its operation, attempt unauthorised access, introduce malicious code, scrape it abusively, misuse another person’s account or use content in a way that infringes our or another person’s rights.

We may suspend access where reasonably necessary for security, maintenance, legal compliance or abuse prevention.

4. Product and service information

We take reasonable care to describe products and services accurately. Images and colours may vary according to display settings. Availability, course dates and capacity can change. Checkfront is the source of live course availability; Shopify is the source of online retail availability after cutover.

If an obvious description or pricing error affects an order, we may contact you to agree a correction or cancel and refund the affected order. We will not substitute a materially different product or service without agreement.

5. Prices and VAT

Prices are shown in pounds sterling and include VAT where applicable unless clearly stated otherwise. Delivery charges and any other mandatory costs will be shown before the customer submits an order.

6. Retail orders and contract formation

Placing an order is an offer to purchase. An automated acknowledgement confirms receipt but does not necessarily mean the order has been accepted. Acceptance occurs when we send confirmation that the order has been accepted or dispatched, depending on the final Shopify notification wording.

We may decline or cancel an order where an item is unavailable, payment is not authorised, delivery is not possible, fraud is suspected or an obvious error has occurred. If payment has been taken, we will refund the affected amount.

7. Payments

Available payment methods are displayed at checkout. Payments are processed by Revolut Payment Gateway and any other provider enabled at checkout. We do not intend to receive or store full payment-card details. Payment providers may conduct fraud and security checks under their own terms and privacy notices.

8. Delivery

Retail delivery is governed by our Shipping and Delivery Policy. Customers are responsible for providing a complete and accurate delivery address and should contact us promptly if an error is discovered.

9. Returns, refunds and faulty goods

Retail cancellation, return, refund, repair and replacement rights are explained in our Returns and Refunds Policy. Sale items retain the same statutory rights as full-price items. Nothing in our policies removes statutory rights for faulty, misdescribed or unsuitable goods.

10. Courses, experiences and training

Courses, experiences, club activities and training services are governed by the separate Course Booking Terms displayed or linked before booking. Those terms cover deposits, validity periods, medical requirements, rescheduling, no-shows, completion requirements, equipment and transport.

Where a retail product and a course are purchased together, the relevant retail and course terms apply to their respective parts.

11. Digital materials and third-party services

Some purchases may involve PADI eLearning, crew packs, certification services or another third-party platform. Additional third-party terms may apply and will be identified where relevant. Any loss of a statutory cancellation right for immediately supplied digital content must be based on the customer’s required consent and acknowledgement; it will not be assumed merely from payment.

12. Gift cards

Shopify gift cards are subject to the value, expiry and redemption information shown when issued. They cannot be exchanged for cash except where required by law. Existing WooCommerce gift-card codes or balances are not represented as migrated unless separately verified.

13. Customer accounts

Customers are responsible for protecting account credentials and for activity performed through their account. Contact us promptly if you believe an account has been compromised.

14. Intellectual property

Website content, branding, text, graphics and original media are owned by or licensed to LSD unless stated otherwise. They may not be reproduced commercially without permission. Third-party marks, including PADI marks, remain the property of their owners.

15. Liability

Nothing excludes liability that cannot legally be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or statutory consumer rights.

Subject to those protections, we are not responsible for losses that were not reasonably foreseeable when the contract was made or for business losses arising from a consumer purchase.

16. Third-party links

Links to Checkfront, PADI, social networks and other third-party services are provided for convenience or service delivery. We are not responsible for independent third-party sites or their terms, except to the extent the law makes us responsible.

17. Changes

We may update these terms for future use of the website or future orders. The version applying to an order or booking is the version made available when the contract was formed, unless a lawful change is agreed.

These terms are governed by the law of England and Wales. Consumers retain any mandatory rights to bring proceedings in another part of the United Kingdom where applicable.
